Question on the CA models with 10 round mags
« on: October 04, 2022, 11:58:36 PM »
I'm sorry if this has been addressed or for being a potentially dumb question, but is it necessary to buy a CA approved model with the 10 round mag, or would it suffice to buy a standard model and simply purchase a 10 round mag to go with it?

Use case is as follows:
I live in AZ but my mom is in CA.  If I decide to bring my CZ to her place (transported in a locked case with the mags out), and God forbid have to use it there, would I be ok with a non CA model (ie a standard PCR) with a 10 round mag?   Or am I better off looking for a CA model and then later buying the 14 round mags for where I live in AZ?
Any other issues to be aware of ?

thanks

For the sake of the CA roster, the appropriate product code determines  allowability of a new gun purchase ( not private party transfer).

The only difference between a CZ sold in Arizona and one that is on the California approved roster but will be sold in California with 10 round magazines supplied will be the bar code and product number on the factory packaging. The guns bear no identification themselves regarding where they can be sold.

While there has been a lot of back and forth in the courts regarding legality of high capacity magazines in California, until there is a definitive definitive iron clad ruling, here is the current Penal Code:

PC 32310.
(a) Except as provided in Article 2 (commencing with Section 32400) of this chapter and in
Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, any person in this state who
manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or
exposes for sale, or who gives, lends, buys, or receives any large-capacity magazine is punishable
by imprisonment in a county jail not exceeding one year or imprisonment pursuant to subdivision
(h) of Section 1170.

Enforcement of the law regarding "possession" of high capacity magazines that are grandfathered in as being owned prior to the ban, or purchased during the so called Freedom Week is not being done at the moment. Unless you do something stupid and you are being brought up on other charges and some D.A. wants to add more charges to your prosecution.

So get a couple of 10 round legal magazines and bring those with you to California. Don't risk bringing any non-compliant magazines into the state. And hope that this gets settled once and for all soon.

Welcome to the most complicated set of gun rules ever.  Since you're transferring a gun to your mom, you can gift her any gun she wants.  It does not need to be on the approved CA roster.  This exception only applies to parent-child relationships and it must be a gift.

When you ship the gun to her FFL, don't include the mags.  Ship them directly to your mom.

Contact her FFL first and make sure they'll accept this transfer.  FFL's in CA constantly misinterpret CA laws.  Even if you decide to go with a CA aproved P-01, the FFL may have differing rules on whether the shipment originates from you directly or from your AZ FFL.

edit: I think I misinterpreted your question.  If you're not transferring ownership of your gun, then only the assault weapons ban applies to you as a visitor.  No threaded barrel, no suppressor.  Only neutered 10 round mags allowed.

Also when you visit CA, bring your own ammo.  CA requires background checks for ammo purchases.  Background checks require a CA ID and proof of residency.

You have two components at issue.
In your example of a PCR purchased by you in Arizona would be legal in California.
The magazines for that PCR would need to be low capacity 10 round magazines in the state of California.
At this time if you or your mother have magazines with a capacity greater than 10 rounds you/her would be subject to scrutiny or prosecution.
No target is too large or to close to miss.

thanks for all of the replies.

So it sounds like I'm good purchasing a 'standard' PCR, but will simply need to acquire some 10 round mags if/when I transport the gun to CA.

I do not need to specifically purchase the 'CA compliant' version of the pistol
