cracked receiver

CZ52 received at my ffl with a cracked receiver. I inspected and found a crack on the receiver above the hole just above the mag insert. I didnt accept the pistol and called the dealer and told him about the crack. They wanted me to send the pistol back to them and they would refund my money. I paid 440.00 for the pistol. But I didnt think I should take delivery of the pistol and left it with the local ffl to call the selling ffl and left. Right now I'm out 440.00. What would be the correct procedure to recover my money.

Ask nicely and hope the dealer refunds you? Other than that, there isn't much you can do. it isn't on the FFL, so anything they do will be at their discretion.

Local FFL is at least a witness to to the condition of the pistol. Possibly a witness to other proceedings that could be detrimental to future business of the ffl dealer.  This forum probably not the best place to discuss options, but thought someone might have some experience with something like this.

A witness? A witness to what? The seller has already agreed to refund your money. It's not the FFL's fault you got a lemon. I don't understand what you are trying to achieve here and why you think the FFL has some involvement or liability.

If you paid by credit card and the seller fails to refund you, file a dispute with your issuer and let them fight it out, but the FFL still isn't a part of your problem.

Sheesh, I thought selling a defective product would make one libel to losing ones license to sell. Especially since their was no ffl paperwork filled out to transfer the firearm, and I didnt take possession of the firearm.  The dealer didnt properly transfer the firearm to me. I'll check with the ATF to see what the next step will be.

According to your OP, your FFL neither sold you the gun, nor transferred it to you. The seller, who is an FFL, has agreed to refund you your money. If they don't, dispute it with your CC company.

Why you are getting bent out of shape at this point is beyond me. Providing the selling dealer complied with the regulations as far as their bound book goes, the ATF will take no interest in a civil complaint that as yet, has not materialized into anything more than an internet bitch about the condition of a firearm.
