I believe that it against the law to convert a mag to fit a different gun..The word convert is the bugaboo..
The good thing is if you are lucky the 40's will work great in
the 9mm mags with no tinkering, aka convert.... Try it and see..
I know of people using 9mm mags in their 40 kel-tec's with no problems.. S

I don't think there is any law against converting a mag to fit a different gun -- I've read through the Federal regs several times.  There IS law that says you can't MODIFY the magazine to exceed the ban limit (10 rounds) if the mag was made after the imposition of the ban.

To make most 9mm mags work with a .40 would probably require some bending of feed lips, at a minimum, and that is MODIFICATION.  Some 9mm mags might work without modification.

Where is it illegal to convert a PRE-BAN 9MM CZ75 magazine to .40S&W, for use in a .40S&W CZ? ARMALITE converts USGI M14 magazines to AR10 magazines all the time. Show me the law.

I didn't say it was illegal.  You didn't read what I wrote.

You're dealing with a gray area and you're not going to find any clear answers.   Anywhere.
