Shipping handgun parts
« on: October 27, 2010, 02:46:48 PM »
Is it legal to ship a SP 01 to a private party in NC if I break down the gun and ship the slide/barrel in 1 box and the frame in another ? My son is in NC until Dec and would like me to send him his CZ, or do I have to do that through a FFL ??

Thanks in advance......

No.

There are some parts that are considered the gun (usually the ones with serial numbers), and some parts not, so you could not ship an entire gun as parts without a Federal Firearms Licensee.

Definitely not, bad juju, violates several US laws, not to mention many possible state laws in both states. Ship via an FFL to an FFL, where he will have to complete the 4473 and any state requirements to pick it up, plus pay a minor "receive" fee. BEST way by far.

As a side note, I just read on a different Forum that a gentleman ships firearms via USPS and declares them hobby parts.  Unless things have changed since I owned a 01 and NFA dealership that's fooling with fire.  If the chickens come home to roost, he'll have to fill out a change of address form....to Marion, IL or Leavenworth,KS, etc.

How about a Kadet 'kit'?

Would that require an FFL transfer and 4473?

Frame is considered as the firearm so Kadet kit is fine.

Armoredman:  The poster on the other Forum was rather indignant when I said there were several "exposures" in that plan that might result in a less than favorable outcome = his donkey is Grass and "the man's" the lawnmower.  I have never spent time in a jail and do not intend to in my life.  It's simple play by the rules.  First by the ones in that Big Black Book (in some cases other colors) the one that starts "In the beginning" and then by the local state and Federal laws, even if I don't like them.  Funny how that works.
I think he was annoyed when I said of all the people in the US Gun Owners should be the dead last to circumvent the system.

A couple of years ago (things may have changed) I was instructed by a warranty station for a particular gun manufacturer to field stip the pistol and wrap each item separately and identify each part on the outside of the bubble pack for that part and send all the parts via UPS to him in another state...I am not a FFL...I went to the UPS store near me and indicated that the package contained a firearm that had been stripped down to parts and no part was capable of firing a round...the owner said no sweat and marked things just that way...it went standard UPS ground.  Seems everyone on this situation either was not aware or felt there is no law to prevent this...I doubt any of they would have purposly broken the law.  That's the only time I ever had any issue with anything like this... by the way, the UPS store owner said a complete firearm could be shipped UPS but would have to go from a dealer to another dealer and had to go UPS air...

He was almost right. There is no Federal legal requirement that firearms may only be shipped FFL to FFL.  It is quite within the Federal regulations for you to ship direct to the manufacturer for repair or replacement.

A UPS Store wouldn't let me ship my barrel and slide to FNH (fixed, combat night sight job for the Five-seven), even though those parts don't count as, "the gun." I was pointed to their main shipping area which could do it,  but they were closed when I got there. Wound up Fed-Ex-ing it instead. What a hassle.  >:(

UPS stores aren't very good, same with FedEx stores..
best place is to go to the main terminal. Local folks here are really good on knowing the regulations and are easy to work with.

As an add on to my shipping UPS story before...the UPS stores won't (at least here) take ammo even with the ORD ;abel...have to go to the main UPS depot and then no sweat...just need the sticker, etc and it's good to go...
