So far, the 3rd District has upheld New Jersey's magazine ban, so that district is in conflict with the 9th. Makes it more likely that the Supreme Court will take the case and make a ruling for the entire country. Of course Roberts will need to remember his philosophical background for the conservative justices feel comfortable enough to grant certiorari.
