"(9) $75,000,000 for grants to States to upgrade criminal and mental health records for the National Instant Criminal Background Check System, of which no less than $25,000,000 shall be for grants made under the authorities of the NICS Improvement Amendments Act of 2007 (Public Law 110-180);"
Under fix NICS-
" (g) Technical Assistance.--The Attorney General shall direct the Office of Justice Programs, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and the Federal Bureau of Investigation to-- ``(1) assist States that are not currently eligible for grants under this section to achieve compliance with all eligibility requirements; and ``(2) provide technical assistance and training services to grantees under this section.''
" (e) Incentives.--For each of fiscal years 2018 through 2022, the Attorney General shall give affirmative preference to all Bureau of Justice Assistance discretionary grant applications of a State or Indian tribal government that received a determination of substantial compliance under subsection (c) for the fiscal year in which the grant was solicited.''
``For purposes of the preceding sentence, not later than 60 days after the date on which the Attorney General receives such information, the Attorney General shall determine whether or not the prospective transferee is the subject of an erroneous record and remove any records that are determined to be erroneous. In addition to any funds made available under subsection (k), the Attorney General may use such sums as are necessary and otherwise available for the salaries and expenses of the Federal Bureau of Investigation to comply with this subsection.''.
Under title V stop school violence act -
. 2706. RULES OF CONSTRUCTION. ``(a) No Funds To Provide Firearms or Training.--No amounts provided as a grant under this part may be used for the provision to any person of a firearm or training in the use of a firearm. ``(b) No Effect on Other Laws.--Nothing in this part may be construed to preclude or contradict any other provision of law authorizing the provision of firearms or training in the use of firearms.''.
It does seem toned down compared to what was being talked about. At least they put some time limits on appeals but dang 2 months and it's one person the AG. It also allows for physical hardening of schools with metal detectors, locks, etc.
However, I am not a fan of ATF and FBI helping anyone locally at all. Its just an invite for data mining. One has dropped the ball to much to be trusted, including the recent Parkland shooting. The other changes it's mind every other month what intent means and legislates as a bureaucratic entity as well as keeps private data longer than they are supposed to.
Aside from that, shouldn't the incentive be to, you know, prevent an illegal activity that leads to murder? That's like incentivizing record keeping in healthcare; you keep em to provide consistent high quality care and track outcomes to improve your delivery of services not to get a bonus or wink wink head nod when applying for a loan to get that new office open. It also does stipulate no monies may be used to procure firearms or firearms training.
Could have been worse. Good talking points though, the issues closer to home like whether your state has or wants Baker Act type legislation that may be easily abused, a desire to ban semi autos, impose absurd magazine capacity limitations, etc. Are the more sinister concerns. These bills can just give restrictive states the means to execute things like that with federal monies.
