New AZ bills on Gov desk
« on: July 02, 2009, 06:31:55 AM »
One to allow CCW permit holders to carry concealed in resteraunts that serve alcohol, and do not post signs against it, and the permit holder does not consume any alcohol. Good idea.
Next, employers cannot stop law abiding citizens from leaving firearms in locked vehicles, or must provide fenced parking are and safe storange for the sidearm. I never leave a gun in the car, but see the point.
Another codifies defensive display, meaning placing your hand on the gun when holstered, or saying "I have a gun" while reaching for it, as a lawful response to threats of physical force. Some have been jailed over the years for this as Aggravated Assault, very good idea. Cannot be used as a defense if the person is committing a crime.
Last makes the change in affirmative defense retroactive, so those who were in limbo when the bill passed originall can go back and try thier defense again. Will help Mr Fish, who shot to stop a dog attack.
We get a little bit better every year here.  8)

Playing Devil's advocate: if it is a CCW then the bartender has no way of knowing if a patron is carrying. What is going prevent someone from carrying and consuming alcohol? It could start of as simple 1 drink and before you know some one is going to cross the line and do something stupid.

I like this law and I know a vast majority will be responsible. But it is going to one or two incidents and this will be repealed.

That said I am a big proponent for allowing employees to leave their guns locked in a vehicle at work. But I don't see that happening.

There is a very simple solution to this problem.  You either don't consume alcohol while carrying your weapon ............... or,  don't carry the weapon !  Which is more important to you...........

You answered your own question - those inclined to break the law are already doing so. Those law abiding people who wish to take a lawfully concealed hand gun to Black Angus Steakhouse can have a good meal while not being disarmed. The bill is CONSTANTLY misrepresented as "guns in bars", it isn't, it's lawful carry in resteraunts that happen to serve alcohol...and in that case, the scenario is even farther off - the bartender never see the patrons at the table. :)

We have a similar bill that pass recently in Ohio so now when I roll into the local Ruby Tuesday's or Applebee's I can carry my CCW as long as I sit in the restaurant section and do not consume alcohol.

I think it's a great amendment to the law to have! Why should law-abiding CCW holders have to be unarmed in a public place if they are not consuming alcohol?

Do people think criminals don't rob restaurants that server liqour?

As for the bill to stop employers from prohibiting employees from keep their CCW's in their vehicles while at work I think this is a great bill and wish we'd have it here in Ohio.

I have family members who work in downtown columbus and park in a rather shady parking garage and work late hours, but their employer will fire them if they carry their weapon into the parking structure!

So my family members have to walk out late at night to a dark garage in a seedy section of town to their vehicles unarmed, then drive through downtown columbus to their homes without their weapon. Seems idiotic to me.

How will the employer know that you have a weapon in your car?

Cameras in the parking garage for one and there is always the chance you would get caught and it's ground for immediate termination.

I just wish everyone respected the 2nd amendment and stopped trying to disarm everyone to make the world a utopia.....

This one started several years ago when AOL had an office in Tucson. Some AOL emplooyees decided to go shooting after work, and consolidtaed thie rifles in one trunk before leaving. Another empolyee witness the transfer, and reported it. All involved were fired.
I don't have to worry about it - we provide gun lockers at Traffic Control, but there are a lot of people who can't carry into work who would feel better driving home, maybe late night in bad parts of town.

That's just stupidity on the employees' part. They brandished their weapons on their employer's property. If they kept the gun in the car and their mouths shut, they would have been fine.

That's the point, they didn't brandish, they handled them moving from one trunk to another, legal in AZ, as we have very very few restrictions on carry here. As for keeping mouths shut, well, that's the one who called the company dogs on them for doing a legal activity. All in all, it will be another minor improvement, as we keep trying to get to Vermont style carry here. :)

AZ may have very liberal gun laws, but the employees should not have moved the guns from one car to another. You always have one person who will report to the boss any activity they don't condone.

We have excellent firearms related laws, and the employees did nothing illegal, that's the point, but I won't debate it further here. We'll leave it up to the governor, now. :)

Let me clarify.
I think it is a good law and I hope it gets passed.
I just think the employees were stupid. They knew what they were doing was against the company rules, and chose to flagrantly disobey them, hence, my "brandishing" comment.
What they did may not have been illegal, but that doesn't make it right.
It's kind of like looking at pornography at work, or using your business phone for personal long-distance calls. Not illegal, but stupid to do, especially if you know you can get fired for it. I don't think that the tattle-tale did anything wrong, either. Even they they were probably anti-gun wimps, they simply reported behavior that was clearly against company policy.

That said, I would carry one concealed in my car and keep my lips sealed until this awesome law comes into effect. I'd like Texas to have one like it.
